It’s clear that businesses in the UK are increasingly understanding how important it is to protect their innovative research by securing patents in European markets.
The Annual Report 2017 from the European Patent Office (EPO), was published at the beginning of this month, and shows that there was an increase of 2.4% in patent applications from companies in the UK.

Crocs produce footwear that is extremely successful and very recognisable. However, this hasn’t stopped them losing the right to protect their design from copycat designers.
An EU Court recently upheld a 2016 decision by the European Intellectual Property Office (EUIPO) to strip the company of its design protection under IP laws.

Dawn Ellmore examines Levi Strauss & Co’s trade mark battle with China
Levi’s is taking action against two Chinese companies for trade mark infringement. The clothing company sued the companies in 2017 over their use of Levi’s trade marked ‘arcuate’ stitch.
This is the arched stitch on the back pocket of all its jeans. Levi’s said: “Levi Strauss & Co. can confirm that it filed a lawsuit on November 20, 2017 against third parties in China in relation to a trademark infringement of its trademarked ‘arcuate’ stitching design.”

Dawn Ellmore – The recent trade mark defeat for Whole Foods
Earlier in March, the UK Intellectual Property Office (IPO) ruled against an opposition from grocery store chain Whole Foods Market against a trade mark application from another party.
The IPO found no risk of confusion between Whole Foods’ trade mark and the application filed by Muhammed Awais and Ishtiaq Ahmad in March 2016. The trade mark applied for is a green circle layered on a black square with “Whole Foods Earth” in white inside the circle. It was filed under section 35 – retail services in relation to foodstuffs.
